TechFix - Serhii Yahupets

General Terms and Conditions

Last updated: 31.10.2026 · Version 1

The German version of this page is legally authoritative; this translation is provided for convenience.

1. Scope

These General Terms and Conditions apply to all repair orders between TechFix - Serhii Yahupets and its customers, whether consumers or business customers.

2. Contracting party

The contracting party is TechFix - Serhii Yahupets. Full details are available in the legal notice (Impressum).

3. Formation of contract

A repair inquiry submitted online, by email or by phone is a non-binding inquiry. A repair contract is only formed once we have the device and the customer agrees to the diagnosis or quotation - at our premises, by email or by phone - or once a binding repair order is explicitly placed.

4. Inquiries and quotations

A non-binding preliminary online assessment does not replace an in-person technical diagnosis. A binding quotation, where required, is prepared through sevdesk and presented to the customer for approval before chargeable work begins.

5. Diagnosis

The device is diagnosed before repair work begins. A diagnosis fee may apply and will be communicated to the customer in advance.

6. Customer's duty to cooperate

The customer must describe the fault to the best of their knowledge and provide all information relevant to diagnosis.

7. Device acceptance

When the device is accepted, an intake report documenting condition and accompanying accessories is created.

8. Accessories

Accessories handed over are recorded in the intake report and returned upon collection, unless required for the repair.

9. Data backup

Before handing over or shipping the device, the customer makes a complete backup of their data; a repair may require the device to be reset. We are liable for data loss under clause 25, but only to the extent the damage would also have occurred had the customer backed up their data properly.

10. Access credentials

Where required for the repair, the customer voluntarily provides access credentials (e.g. a device PIN). These are used exclusively to carry out the repair and retained for the shortest practical time. The customer should, where possible, only disable accounts and access locks to the extent actually required for the repair.

11. Repair authorization

Repair work only begins once the customer has agreed to the quotation or repair order.

12. Additional work

If further defects are found during repair, we inform the customer before carrying out any additional chargeable work.

13. Spare parts

Original, refurbished, or compatible spare parts of equivalent quality may be used. On request, we inform customers in advance about the type of parts used.

14. Repair time

Stated repair times are non-binding estimates. We inform the customer of any foreseeable delay.

15. Unsuccessful repair

If a repair is technically impossible or not economically reasonable, we inform the customer. In that case, only the agreed diagnosis fee, if any, is charged.

16. Collection and return

The device can be collected during normal opening hours once the repair is complete. The customer is informed once the device is ready.

17. Mail-in repair

The customer may also send the device to us by post. The customer bears the shipping costs in both directions: they pay the carrier directly for the shipment to us, and we charge the return shipment at the actual postage, stating the amount with the quotation. Devices should be sent as a parcel with tracking and liability cover. The carrier is liable for loss or damage in transit under its terms of carriage; the claim is made by whoever sent the parcel - the customer for the shipment to us, we for the return shipment. The device is returned to the address the customer gave. For consumers, the statutory rules on the passing of risk remain unaffected.

18. Remuneration

Remuneration follows the approved quotation or repair order. Invoices are issued through sevdesk.

19. Accounting documents

Quotations, invoices, advance invoices, final invoices, and credit notes are created and managed through the external service sevdesk. TechFix - Serhii Yahupets no longer keeps an internal accounting system of its own.

20. Advance payments

An advance payment may be agreed for more extensive repairs. Services already rendered are credited on cancellation; any further claims are governed by statutory provisions.

21. Right of retention

Until the due remuneration has been paid in full, we hold a statutory right of retention over the repaired device.

22. Retention of title

Installed spare parts remain our property until paid in full, to the extent legally permissible.

23. Statutory warranty

Statutory warranty rights (defect rights) under the German Civil Code (BGB) apply. These are not limited by any voluntary guarantee.

24. Voluntary guarantee

In addition to statutory defect rights, a voluntary guarantee may be granted for the repair performed, as set out in the issued warranty certificate. This supplements, and does not replace, statutory rights.

25. Liability

We are liable without limitation for intent and gross negligence and under mandatory statutory provisions (including product liability law, injury to life, body, or health). Otherwise, we are only liable for breach of material contractual obligations, limited to the foreseeable, typical damage.

26. Force majeure

In the event of force majeure, we are released from our obligation to perform for the duration of the disruption.

27. Provisions for business customers

The following additionally apply to business customers: company and order data (contact person, purchase order reference, billing address) is processed as provided in the business account; agreed payment terms apply as stated in the relevant sevdesk document.

28. Provisions for consumers

Consumers have a right of withdrawal under the statutory conditions - see the withdrawal instructions for details. Statutory consumer rights are not limited by these terms.

29. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state of their habitual residence. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our place of business. Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected.
