Withdrawal Instructions

Scope

A statutory right of withdrawal exists only for consumers and only for distance contracts or contracts concluded away from business premises (§§ 312g, 355 BGB). Whether a right of withdrawal exists depends on how the contract was concluded.

In-person contracts at our premises

Where a repair order is placed in person at our premises, it is generally not a distance contract or a contract concluded away from business premises; in that case no statutory right of withdrawal generally exists.

Orders placed online or by phone

Where a repair order is placed online, by phone, or by a comparable means of distance communication, consumers have the following statutory right of withdrawal:

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded. To exercise your right of withdrawal, you must inform us (TechFix - Serhii Yahupets, Scharnhorststraße 1, 09130 Chemnitz, email: techfixchemnitz@gmail.com, phone: —) of your decision to withdraw from this contract by an unambiguous statement (e.g. a letter or email). You may use the enclosed model withdrawal form, although this is not mandatory.

Meeting the deadline

To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days from the day we receive notice of your withdrawal. We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. If you requested that the service should begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of services already provided until you notified us of your withdrawal, compared with the full scope of services provided for in the contract.

Explicit request for an early start

If diagnosis or repair should start before the withdrawal period expires, we ask you to explicitly confirm this request and your awareness that your right of withdrawal will be lost once we have fully performed the contract before the period expires.

Expiry of the right of withdrawal

For a contract to provide services, your right of withdrawal expires early once we have fully performed the service, provided we only began performance after you gave your express consent and confirmed your awareness that you would lose your right of withdrawal upon full performance.
